What You Can Expect from a CPS Investigation
By law, when a report of child abuse or neglect reaches CPS, a caseworker
must go out to see the child and family to see if there is any evidence
to support this claim.
Reasons for a CPS investigation generally include reports of:
- Abuse of a child
- Neglect of a child
- Drug use in a child's residence
- Domestic violence in a child's residence
After an investigation, the caseworker could decide the following results
of the investigation:
- There is "reason to believe" the reports of abuse or neglect
- The claims are "ruled out" as erroneous
- The investigation was "unable to determine" either of the above
About CPS & Relocation Cases
If you are afraid that relocating your child to a family violence shelter
could jeopardize your custody rights, you should know that seeking shelter
will likely be viewed in a good light. This is because you are showing
that you are taking steps to protect your child from harm. Furthermore,
a CPS investigation will not give away your whereabouts.
Whatever the situation, your child would not be at risk of removal unless
there is immediate harm present. Even if a child is removed from their
parents, this is temporary in most cases. Depending on the investigation,
however, parents may have to abide by a safety plan or service plan imposed
by what CPS views as the best option for the child's protection. If
parents break these rules, they may lose custody.

In many cases, parental courses, child day care, and other community resources
could be supplied by the CPS, enabling parents or guardians to preserve
their rights and keep custody of their child. In other cases, it may be
possible to show evidence that can clarify a mistaken report and clear
a family's name.
