HOW CAN A PROTECTIVE ORDER HELP YOUR FAMILY?

Family violence is considered any time a family or household member attempts to physically harm or sexually assault another member of the family. A current or former spouse, a blood relative, an in-law, or even a roommate can all be guilty of family violence.

There are essentially two kinds of protective orders - temporary ex parte and permanent. The former provides immediate protection and usually lasts for only 20 days. A permanent order is assigned by the court and typically lasts up to two years.

Either order can prevent the abuser from:

  • Continuing to harass or torment you
  • Communicating with you
  • Visiting your home or place of work
  • Having unsupervised visits with your children
  • Owning any firearms
  • Receiving child custody from the court

If you wish to obtain a protective order from the court, you must first fill out the application and include any necessary forms. After reviewing your application, the court will then schedule a hearing, at which point the judge will determine if a protective order is indeed necessary.
